The Case Background
The clients had been married for 8 years and had a 6-year-old daughter. Over time, irreconcilable differences led them to seek separation. Initially, both parties were highly adversarial, claiming sole custody of the child and contesting maintenance figures.
Why Mediation Was Selected
Rather than initiating a lengthy trial in the Mumbai Family Court, I advised our client to propose structural mediation. Mediation is a confidential process facilitated by a neutral third party that focuses on finding mutually acceptable solutions rather than assigning blame.

- Co-Parenting Plan: Agreed on joint legal custody with shared physical residency during summer and winter vacations.
- Structured Maintenance: Reached an agreement on a one-time alimony lump sum, backed by a trust fund designated exclusively for the child's higher education.
- Expedited Decree: Filed a petition for Mutual Consent Divorce, resulting in the decree being granted swiftly upon completion of the statutory 6-month cooling period.
